South Alabama Electric Cooperative, Inc., its subsidiaries, partners, affiliates, agents, officers, directors, and employees (hereinafter collectively referred to as "SAEC") make no warranties and representations of any kind or character regarding the information (hereinafter called "Content") submitted to, contained in or derived from this web site. All corporations, entities, associations, and persons (hereinafter collectively referred to as the "Users") specifically acknowledge that no representations or warranties whatsoever are made regarding the Content. Further, all Users specifically acknowledge their agreement with this disclaimer and confidentiality agreement and that their use and access to the Content are subject to the following terms and conditions:

The Content is made available on an "as is, where is" basis with no representation or warranties of any kind, either expressed or implied, including but not limited to, merchantability, fitness for any purpose, and non-infringement.

The User shall indemnify, hold harmless and defend SAEC from and against any and all claims for loss, damage or injury to any person or property arising from or related, directly or indirectly, to the Content or the use thereof. This includes, without limitation, all claims for replacement energy and capacity, business interruption, indirect, incidental, consequential, special, exemplary, punitive or other damage of any kind or character.

The Content may contain typographical or other errors. The User assumes full responsibility and all risk and liability from and associated with access to, use of or reliance upon the Content. The User is solely responsible for and shall make independent appraisals and investigations of the condition, affairs, status and nature of the Content contained herein, any and all other pertinent matters, and the User's system and business operations.

The User specifically acknowledges that the Content may be incomplete, incorrect, and not applicable to the User's operations. The User's sole remedy for dissatisfaction with the Content is to stop using the Content.

The User specifically acknowledges that the Content contains information, which is confidential and proprietary in nature to SAEC. The User shall not reproduce, copy, redistribute, disclose or communicate the Content to any third party without the prior written consent of SAEC. The User shall reasonably protect the Content with the same or greater degree of care, which the User employs to prevent the unauthorized use, dissemination or publication of its own most valuable confidential and proprietary information.
